Key Obligations — Read Before Creating Events
- You are the event organizer — Famelee is only the platform
- You are solely responsible for your event, attendees, and legal compliance
- You must refund buyers if you cancel your event
- You bear full liability for chargebacks and disputes
- Famelee may hold funds for up to 90 days in case of disputes or fraud
- You are responsible for collecting and remitting all applicable taxes
- You indemnify Famelee from all claims arising from your events
1. Introduction
This Organizer Agreement ("Agreement") is between you ("Organizer," "you") and Famelee ("Platform," "we," "us"). Famelee provides a technology platform that enables event organizers to list events, sell tickets, and manage attendees. Famelee is a marketplace and intermediary — we are not the event organizer, co-host, or promoter of any event listed on the platform. All responsibility for event execution, safety, and compliance rests solely with you.
2. Acceptance
By creating an event on Famelee, you agree to be bound by this Agreement in addition to our general Terms of Service and Privacy Policy. If you do not agree to any part of this Agreement, you may not create events on Famelee.
3. Organizer Responsibilities
As an event organizer on Famelee, you are solely responsible for:
- Planning, promoting, and executing your event
- The safety and well-being of all attendees at your event
- Obtaining all necessary permits, licenses, and insurance for your event
- Ensuring your event complies with all applicable federal, provincial, and municipal laws
- Accurately representing your event in all listings, descriptions, and promotional materials
- Providing adequate venue capacity, accessibility, and safety measures
- Communicating any changes, postponements, or cancellations to ticket holders promptly
4. Payment Processing & Stripe
Famelee uses Stripe to process ticket payments. If you choose Stripe as your payout method, you must create and maintain a Stripe Connected Account. By doing so, you also agree to Stripe's Connected Account Agreement.
If you choose Interac e-Transfer as your payout method, Famelee collects payments on your behalf through our Stripe account and remits your earnings via e-Transfer after the event. You must provide a valid government-issued photo ID and e-Transfer email address before receiving payouts.
5. Service Fees
Famelee charges a service fee on each ticket sold. The current fee structure is displayed during event creation and on the ticket checkout page. Service fees are paid by the buyer and are separate from the ticket price you set. Famelee reserves the right to modify the fee structure with reasonable notice to organizers.
6. Payout Terms
Payouts are processed as follows:
- Stripe Connect: Funds are transferred directly to your Stripe account at the time of purchase, minus Famelee's service fee.
- Interac e-Transfer: Payouts are processed after the event concludes. Famelee reserves the right to hold funds for up to 30 days after the event date to account for refund requests and chargebacks.
Famelee is not responsible for delays caused by your bank, Stripe, or Interac. Payouts are made in Canadian Dollars (CAD).
7. Payment Holdback & Reserve Rights
Famelee reserves the right to hold back, delay, or reserve a portion or all of your funds in the following circumstances:
- Pending or anticipated chargebacks
- Suspected fraud or misrepresentation
- Buyer complaints or disputes
- Violation of this Agreement, our Terms of Service, or Community Guidelines
- Event cancellation or failure to deliver the event as described
Holdback periods may last up to 90 days from the event date or until all disputes are resolved, whichever is later.
8. Chargeback Liability
You bear full liability for all chargebacks related to your events. If a buyer initiates a chargeback with their card issuer, Famelee may deduct the chargeback amount plus any processor fees from your current or future payouts. If your payout balance is insufficient, you agree to reimburse Famelee for the outstanding amount within 14 days of notification.
9. Refund Obligations
You must comply with the following refund requirements:
- Cancelled events: You must provide a full refund to all ticket holders if you cancel your event.
- Postponed events: If your event is postponed by 90 or more days, ticket holders are entitled to a full refund upon request.
- Your refund policy: You must select a refund policy (refundable up to 48 hours before the event, or no refunds) when creating your event. This policy is displayed to buyers before purchase.

10. Tax Responsibility
You are solely responsible for determining, collecting, reporting, and remitting all applicable taxes (including but not limited to HST, GST, PST, and income tax) arising from your ticket sales and events. Famelee does not collect or remit taxes on your behalf and does not provide tax advice. You should consult a qualified tax professional regarding your obligations.
11. Prohibited Events & Content
You must not create events or post content that violates our Community Guidelines. This includes, but is not limited to:
- Fraudulent, deceptive, or misleading events
- Events promoting illegal activities
- Events containing hate speech, threats, or harassment
- Events with sexually explicit content
- Events that violate Stripe's acceptable use policies
Famelee reserves the right to remove any event at its sole discretion without prior notice.
12. Content License
By listing an event on Famelee, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, distribute, and promote your event content (including titles, descriptions, images, and logos) on the Famelee platform and in our marketing and promotional channels. This license exists for the duration that your event is listed and for a reasonable period after for archival and promotional purposes.
13. Indemnification
You agree to indemnify, defend, and hold harmless Famelee, its founder, officers, employees, agents, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your events, (b) your content, (c) your breach of this Agreement, (d) your violation of any applicable law, or (e) any dispute between you and an attendee or third party relating to your events.
14. Termination & Fund Withholding
Famelee may, at its sole discretion and without prior notice:
- Suspend or terminate your organizer account
- Remove any or all of your events
- Withhold or freeze pending payouts
- Deduct amounts owed to Famelee (chargebacks, fees, damages) from your payouts
All outstanding obligations under this Agreement (including indemnification, chargeback liability, and refund obligations) survive termination.
15. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this Agreement shall be resolved in the courts of Ontario, Canada.
16. Changes to This Agreement
Famelee may update this Agreement at any time. We will notify organizers of material changes via email or platform notification. Your continued use of Famelee after changes take effect constitutes acceptance of the updated Agreement.
